1. Use of Service

• • You must be 13 years or older to use our services.
• • You agree to provide accurate account information and keep it up to date.
• • You're responsible for any activity that occurs under your account.

2. AI Assistant

• • Our AI assistant, Mindrix Assist, can configure, optimize, and help manage your server.
• • The AI provides suggestions and performs tasks based on your input, but it's your responsibility to review changes before deploying.
• • We are not liable for unintended actions taken via AI suggestions or automation.

3. AI Chat Data and Service Improvement

• • Your chat conversations with Mindrix Assist may be used to improve our AI services and provide better assistance.
• • We analyze chat patterns to enhance response quality, fix issues, and develop new features.
• • Personal information and sensitive server data are not used for training purposes.
• • During the beta period, this data collection cannot be disabled, but will become optional once beta concludes.
• • You can contact support if you have concerns about specific conversations.

4. Server Hosting and Uptime

• • We strive for 99.9% uptime, but we do not guarantee uninterrupted service.
• • Planned maintenance or unforeseen downtime may occur. We will notify users when possible.

5. Pricing and Billing

• • New Customer Pricing: Pricing may change for new customers at any time. Current pricing is posted on our website.
• • Existing Customer Protection: Existing customers will maintain their current pricing (grandfathered rates) unless we provide 30 days advance notice of any changes to existing subscriptions.
• • All charges are processed via Stripe or approved third-party payment processors.
• • Failure to pay on time may result in suspension or termination of your server.

6. Refunds

• • All payments are non-refundable, unless required by law.
• • If you believe there was a billing error, contact us within 7 days of the charge.

7. Acceptable Use Policy

You may not use MindrixHosting to:

• • Host or distribute malware, exploits, or pirated software.
• • Harass, abuse, or threaten others.
• • Attempt to bypass, disable, or tamper with our AI safeguards or system protections.
• • Attempt to reverse-engineer, extract, or replicate our AI models or proprietary technologies.
• • Run non-Minecraft-related services without permission.
• • Conduct cryptocurrency mining or other resource-intensive activities unrelated to Minecraft.

We reserve the right to suspend or terminate any account that violates our policies.

8. Referral Program

• • Users may earn account credits by referring new customers through their unique referral link.
• • Referral credits are awarded when the referred user purchases an eligible plan (Iron tier or higher, minimum $4).
• • Pending referral credits expire after 7 days if the referred user does not complete an eligible purchase.
• • Self-referrals are prohibited and will not be credited. This includes creating multiple accounts, using variations of your email, or coordinating with others to abuse the referral system.
• • We reserve the right to deny or revoke referral credits for suspicious activity, fraudulent behavior, or violation of these terms.

Reversal & Chargeback Policy:

• • If a referred purchase is refunded, charged back, or disputed, the referral credit will be reversed.
• • Credit reversal follows this order:
  • 1. First, deducted from your available referral credit balance
  • 2. If insufficient, deducted from your Stripe account balance
  • 3. This may result in a negative balance on both accounts
• • Example: You earned $5, spent $3 on your subscription. Friend refunds. We deduct $3 from your $2 remaining credit (now -$1) and $2 from your Stripe balance.
• • Negative balances must be resolved before creating new servers or accessing certain features.
• • You will be notified of any reversals and given the opportunity to resolve negative balances.
• • Repeated chargebacks or abuse may result in permanent suspension from the referral program or account termination.

9. Resource Usage Limits

• • Servers must be used reasonably and not abuse shared resources allocated to your plan.
• • Excessive CPU, RAM, or bandwidth usage may result in throttling or suspension of your server.
• • AI assistant usage may be rate-limited during beta to ensure fair access for all users.
• • We monitor resource usage to maintain optimal performance for all customers.

10. Backups and Data

• • We take regular backups of server data, but we recommend users keep their own backups.
• • We are not responsible for data loss due to user error or third-party plugin behavior.

11. Intellectual Property

• • You retain ownership of your server content.
• • All platform code, AI features, and branding belong to MindrixHosting.

12. Termination

• • You may cancel your service at any time via your dashboard.
• • We may suspend or terminate your account if you violate these Terms.

13. Limitation of Liability

MindrixHosting is not liable for:

• • Downtime, loss of data, or server errors.
• • Decisions made by the AI on your behalf.
• • Any damages beyond the amount you paid us in the past 30 days.

AI Assistant Disclaimer:

• • You acknowledge that AI suggestions may not always be optimal for your specific use case or server configuration.
• • Always test AI-generated configurations in non-production environments when possible before applying to live servers.
• • You are solely responsible for reviewing and approving any changes suggested or implemented by our AI assistant.

14. Changes to These Terms

• • We may update these Terms from time to time.
• • If we make significant changes, we will notify users via email or dashboard alerts.
